i.e.: If you owe IRS for 2003, did you file and pay 98-02?

IRS Requirements: This is the sticky part. You must meet these requirements or you won't qualify for this deal. It doesn't mean IRS will refuse to come to some sort of an arrangement with you - I'll still get them to release your Wage Levy - it just means that the deal will probably be different and may take a bit more time.

  • The aggregate unpaid balance of assessments is $25,000 or less. The unpaid balance of assessments includes tax, assessed penalty and interest, and all other assessments on your account.
  • It does not include accrued penalty and interest. This is confusing. You can owe penalty and interest, but IRS may not include all of it to determine if the $25,000 limit. To limit the confusion, let's just say that we let the IRS computer system make the calculation (although I'll check it for accuracy).
  • Your Collection Statute Expiration Dates will come into play, too. This means that if you have any tax balances that are about to expire due to the Statute of Limitations (generally ten years after the tax was assessed), IRS will want to collect that tax before expiration. I have other ways of dealing with this issue.

I will get IRS to release your levy in 3-5 business days and set up a monthly installment agreement for you, for over the next 5 years (required by IRS)...

  • Power of Attorney
  • Personal Info Sheet
  • Financial Info Sheet
  • Payment Authorization
  • Also collect all of the information listed on the Checklist at the back of the Package.
  • Be sure to fax me your most recent paystub(s) with year-to-date info.
  • Print out, sign and date the Statement of Agreement below.
  • Fax above to me at 817/263-0770. (You should be able to get all of this information together in a couple of days.)
